Vermont Supreme Court: Motocross Association Not Liable For Crash
DERBY - The Vermont Supreme Court has ruled that Vermont Motocross Association and the owner of Rider Hill in Derby are not liable in a 2002 accident that left Clint Provoncha a paraplegic.
In March, the high court upheld a summary judgment issued in Orleans Superior Court which said that Provoncha waived his rights to sue when he signed a race day entry form the day before his accident.

Act and Signed Waiver Protect Defendants in Ski Accident Case
A federal judge from the District of Massachusetts has granted summary judgment to a group of defendants, who were sued by a skier, who left a proscribed trail and suffered a tragic injury.
The court’s rationale centered on the fact that the collision took place away from the trail and that the skier had signed a liability waiver.

The threat of these lawsuits along with potential expenses involved continues to hang over Vermont's recreation industry.
Thanks for your support and feel free to pass this on,
